1. Seller

These terms of sale apply to all sales made on hushwoven.com, operated by: Alexance MOURIER EI (sole trader, French micro-enterprise), trading as Hushwoven 9 rue André Crétin, 01100 Oyonnax, France SIRET: 939 228 524 00012, registered with the French National Business Register (RNE) VAT not applicable, article 293 B of the French General Tax Code Email: contact@hushwoven.com. Phone: +33 1 89 52 99 53

2. Scope

These terms apply to consumers, meaning adults buying for non-professional purposes. They prevail over any other document. By placing an order, you confirm that you have read and accepted them. The terms that apply are those in force on the date of your order.

3. Products

We sell knit socks in sets of several pairs. The main characteristics of each set (number of pairs, colors) are shown on the product page. Photos are as accurate as possible, but colors may look slightly different depending on your screen. Offers are valid while stocks last. If an item becomes unavailable after you order, we will tell you and refund you as soon as possible.

4. Prices

Prices are shown in the currency of your country (euros, US dollars, Canadian dollars or pounds sterling). VAT not applicable, article 293 B of the French General Tax Code: no VAT is charged by the seller. Shipping is free unless stated otherwise; any charge would always be shown before you confirm your order. For deliveries outside the European Union, import duties or taxes may be collected by customs or the carrier; unless shown at checkout, they are not included in our prices and are payable by the recipient. Prices may change at any time; the price that applies is the one shown when you confirm your order. Automatic discounts shown in the cart are applied at checkout.

5. Ordering

To order, select your products, check your cart, enter your contact details and delivery address, read these terms, then confirm your order with an obligation to pay. The sale is concluded when payment is confirmed. You receive an order confirmation email. We may cancel an order in case of an existing dispute with the customer, suspected fraud or refused payment.

6. Payment

Payment is due immediately when you order, by card or any other method offered at checkout (including PayPal). Payments are processed securely by Shopify Payments and PayPal; we never have access to your card details. An invoice is available on request.

7. Delivery

We deliver to France, the European Union, the United States, Canada and the United Kingdom, to the address you provide. Delivery terms are described in our Shipping policy. For customers in the European Union, delivery takes place no later than 30 days after your order is confirmed; if it is late, you may, after giving us a reasonable additional period, cancel the contract and receive a full refund within 14 days (articles L.216-6 and L.216-7 of the French Consumer Code). The risk passes to you when you, or a person you designate, take physical possession of the products.

8. Right of withdrawal

You have 14 days from receiving your products to withdraw from your purchase, without giving a reason (for customers in the European Union, articles L.221-18 et seq. of the French Consumer Code). Tell us clearly, using our online withdrawal form, by email to contact@hushwoven.com, or with the model form in our Refund policy, then send the products back no later than 14 days after telling us. The direct cost of returning the products is paid by you. We refund all amounts paid, including original delivery charges, within 14 days of your notice, using the same payment method. We acknowledge your withdrawal by email without delay, and we may withhold the refund until we receive the products or proof that you have sent them. You may be held liable for any loss in value resulting from handling beyond what is necessary to check the nature, characteristics and condition of the products.

For customers in the European Union, the seller is bound by the legal guarantee of conformity (articles L.217-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code). You have two years from delivery to claim under the guarantee of conformity and only need to show that the defect exists. It entitles you to a repair or replacement within thirty days of your request, free of charge. If repair or replacement is refused, late, causes major inconvenience or fails, or if the defect is serious enough, you may obtain a price reduction or cancel the contract and get a full refund in exchange for returning the product. The guarantee against hidden defects lasts two years from discovery of the defect and entitles you to a price reduction or a full refund in exchange for returning the product. A seller who obstructs the guarantee of conformity in bad faith faces a civil fine of up to 300,000 euros, which may be raised to 10% of average annual turnover (article L.241-5 of the French Consumer Code). Wherever you live, if your order arrives damaged, defective or incorrect, contact us at contact@hushwoven.com and we will replace or refund it.

10. Customer service and complaints

For any question or complaint: contact@hushwoven.com, by phone at +33 1 89 52 99 53, or by post to the address in article 1.

11. Consumer mediation (EU)

In accordance with articles L.612-1 et seq. of the French Consumer Code, if a dispute is not resolved after a written complaint to the seller, consumers may refer it free of charge to the consumer mediator CM2C, 49 rue de Ponthieu, 75008 Paris, France, www.cm2c.net. You remain free to accept or refuse the proposed solution.

12. Personal data

The data collected when you order is needed to process it. How it is used and your rights are described in our Privacy policy.

13. Governing law and disputes

These terms are governed by French law. If you live in another country, you keep the benefit of the mandatory consumer protection rules of your country of residence. If no amicable or mediated solution is found, the dispute may be brought before the competent court.
